These Terms and Conditions (“Terms”) govern your use of the Remindial mobile application and related services (the “App”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About Remindial

Remindial is a personal reminder application that helps you schedule notifications for medications, rides, appointments, and other recurring tasks. Reminders may be delivered via push notification, SMS text message, automated voice call, and on-screen voice playback (text-to-speech), depending on your settings.

Remindial is a reminder tool only. It is not a medical device, medical advice service, or healthcare provider.

If you have any condition where missing a dose or appointment could endanger your health or life, discuss with your doctor whether a reminder app is appropriate for you, and what additional safeguards you should put in place.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Remindial account. By creating an account you represent that you meet this requirement.

If you use Remindial to manage reminders for a minor or another adult (for example, an elderly parent), you are responsible for that person’s information and for obtaining their consent before adding them as a caregiver or recipient.

4. Account and Security

You sign in with your phone number using a one-time password sent via SMS. You are responsible for:

You may delete your account at any time from Profile → Delete Account. Deletion is irreversible.

5. SMS and Voice Call Reminders

When you enable SMS or voice-call reminders, you provide express consent for Remindial to send automated text messages and automated voice calls to the phone numbers you have configured.

If you add a caregiver, partner, or other recipient to a reminder, you represent that you have that person’s permission to send them automated reminders. You are solely responsible for any consequences arising from sending unsolicited messages to others.

Remindial is currently in early access and core features are free. The App may offer optional paid features in the future. If paid features are introduced:

8. Third-Party Services

The App relies on third-party services to operate, including but not limited to: Apple Push Notification Service, Google Firebase Cloud Messaging, Twilio, Message Central, AWS, Supabase, Vercel, Google Maps Platform, and cron-job.org. Outages or errors in these third-party services may cause reminders to be delayed, missed, or duplicated. We are not liable for failures caused by third-party services.

9. Intellectual Property

The App, including its design, source code, logos, name, and all content other than user-generated content, is owned by Remindial and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, revocable license to use the App for your personal, non-commercial purposes.

You retain ownership of any content you create within the App (reminder names, notes, voice recordings). By using the App, you grant Remindial a limited license to store and transmit your content as needed to provide the reminder service.

10. Limitation of Liability

To the maximum extent permitted by law:

You agree to defend, indemnify, and hold harmless Remindial and its operators from any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of:

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or used the App in a way that creates risk for us or other users. You may terminate your account at any time by deleting it from within the App.

Sections of these Terms that by their nature should survive termination (including Sections 2, 5, 9, 10, 11, 13, and 14) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles.

Any dispute arising out of or related to these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

If you are a consumer in a jurisdiction that requires arbitration or alternative dispute resolution, those local rules will apply where mandated by law.

Class Action Waiver. To the extent permitted by law, you and Remindial each agree to bring any dispute against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top and, if changes are material, present an in-app notice asking you to review and accept the updated Terms before continuing to use the App. Continued use of the App after the updated Terms take effect constitutes your acceptance.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Remindial regarding your use of the App, and supersede any prior agreements.
